Terms of service

Last updated 27 September 2026. These terms apply to every order placed with Marble Cinema ("we", "us"), a sole-trader business trading as Marble Cinema, ABN 23 448 593 086, Melbourne, Australia.

1. What we provide

We produce video, reel and image deliverables ("Deliverables") from photographs, floorplans and listing copy that you supply or that you direct us to obtain from a listing you control ("Source Material"). The specific Deliverables, price and turnaround for each order are those shown on our website or in our written quote at the time you order.

2. Your Source Material

  1. You confirm that you own, or hold a licence to use, all Source Material you supply or direct us to, including the right to have it adapted into video and image Deliverables, and that supplying it to us does not infringe any third party's rights, including those of the photographer.
  2. You grant us a non-exclusive licence to copy, adapt and process the Source Material for the purpose of producing your Deliverables and, for the duration of the order, to store it on our systems and those of our processing providers.
  3. You are responsible for the accuracy of listing copy and features you supply for titles and closing cards. We reproduce them; we do not verify them.
  4. Source Material is processed using third-party AI tools, some of which treat uploaded material as non-confidential. Do not supply material that must remain confidential (for example an off-market listing, or photographs showing people, documents or security details) unless we have agreed in writing how it will be handled.

3. How the Deliverables are made, and the accuracy guarantee

  1. Our Deliverables are animated from the Source Material using image-to-video software. Camera movement between and within photographs is generated; the photographs themselves are not altered. A person reviews each frame of the Deliverable against the Source Material before delivery.
  2. Each video Deliverable carries an on-screen notice, normally "Animated from listing photography". You must not remove it.
  3. Accuracy guarantee. If a delivered frame shows a room, view, fixture, finish or item of furniture that is not present in the Source Material, notify us within 14 days of delivery and we will re-cut the affected section at no charge or, at our option, refund the fee for that Deliverable. This guarantee is in addition to your rights under the Australian Consumer Law and does not limit them.
  4. Virtual staging and photo-enhancement Deliverables, where offered, are by their nature altered images. They are labelled as such on screen and in the file name, and the accuracy guarantee in clause 3.3 does not apply to the labelled alterations.

4. Your use of the Deliverables

  1. You are responsible for how the Deliverables are used in marketing a property and for compliance with the consumer, advertising and real estate laws that apply to you, including the prohibition on misleading or deceptive conduct. Do not present a Deliverable as filmed footage.
  2. Do not use a Deliverable to market a property other than the one the Source Material depicts.

5. Turnaround, revisions and delivery

  1. Turnaround times start when we have received workable Source Material and confirmed the order. "Workable" means enough photographs, at sufficient resolution, to produce the Deliverable; we will tell you within one business day if a set is not workable.
  2. Each order includes one round of revisions requested within 7 days of delivery. Further rounds are quoted separately.
  3. Deliverables are provided as downloadable files. Download links may expire after 30 days; keep your own copies.
  4. Turnaround guarantee. Where our website states a delivery time for a package, and we deliver later than that time measured from confirmation of a workable order, the fee for that Deliverable is waived. The guarantee does not apply to delays caused by late or incomplete Source Material, revision requests, or events outside our control.
  5. Free sample room. We may offer one free sample clip per agency, produced from a live listing you control. The sample is for your evaluation only, carries no licence for marketing use, and may be withdrawn or limited at our discretion.

6. Price and payment

  1. Prices are in Australian dollars. Prices shown in other currencies are indicative only; invoices are issued in AUD. We are not currently registered for GST and no GST is charged; this will change if we register.
  2. Orders are confirmed on payment. Invoices are issued on acceptance of a quote and are payable by bank transfer (or any other method stated on the invoice) before production begins; the turnaround time runs from receipt of payment and confirmation of workable Source Material. Deliverables are licensed to you for use on payment in full.
  3. Packages of multiple listings must be used within 6 months of purchase. Monthly office packages renew monthly and may be cancelled with 30 days' notice.

7. Ownership and our portfolio

  1. On payment in full you own the Deliverables and may use them without restriction, subject to clauses 3.2 and 4.
  2. We retain ownership of our methods, templates, prompts, music licences and tooling. Music is licensed to the Deliverable, not supplied as a separate file.
  3. We will not publish, post or show your Deliverables or Source Material publicly, including on our own website or social media, without your written permission.

8. Australian Consumer Law and liability

  1. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.
  2. To the extent permitted by law, our total liability for any claim arising out of an order is limited to re-supplying the Deliverable or refunding the fee paid for it, and we are not liable for indirect or consequential loss, including lost commission or lost sales.
  3. You indemnify us against claims by third parties arising from Source Material you supplied without the necessary rights, or from your use of the Deliverables in breach of clause 4.

9. Cancellation

You may cancel an order before we begin production for a full refund. Once production has begun, the fee for that Deliverable is payable. If we cannot produce a workable Deliverable from your Source Material, we will tell you and refund any amount paid for it.

10. Privacy

We handle personal information in accordance with our Privacy policy.

11. General

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction. If any clause is unenforceable it is severed and the rest continue. We may update these terms; the version in force is the one published on our website when you place an order.
